Chapter 10 Replacement of Refund: Choosing a Remedy

When settling a lemon law case, the consumer has options:
  • Return the vehicle for a refund
  • Return the vehicle for a replacement
  • Keep the vehicle and receive money

Did you know you don't have to accept the manufacturer's choice?

If you select refund, the Song Beverly Act, California's lemon law specifies what you are allowed to recover. Read this chapter to fully understand what you are entitled to under the law.

Is the consumer entitled to recover vehicle taxes and license fees?

You may have heard about the "mileage offset". This is an amount of money the manufacturer is entitled to keep based on the miles on the vehicle at the time of the first repair attempt.

Replacement: If you elect to accept a replacement what the law says comparable. Chapter 10 describes exactly what comparable means.

What about Incidental and Consequential damages?

Can you get compensation for the accessories you put on your vehicle? This is a gray area so we cover it carefully in this chapter.

"Thank you for everything

"The dealership kept shoving me out on a crutch, and wouldn't take me seriously without you. Complaining did nothing.

"Thanks for taking the hassle off my shoulders in dealing with my lemon. I barely have time to sleep, let alone deal with problems I shouldn't have to."
